Harrison Workers Win $1.25 Million
nion workers at FE’s Harrison Power Station will receive $1.25 million in backpay under a settlement agreement hammered out by the UWUA to resolve numerous unfair labor practice charges against the company at the West Virginia facility.
The settlement also requires FE to grant an immediate 6% pay increase and to reinstate and even improve incentive bonuses and other benefits that were gutted by the company at the Harrison plant, including employee healthcare, long-term disability, and sick leave benefits.
“This settlement is a huge victory for Harrison workers,” declared UWUA National President Michael Langford. “The solidarity of UWUA members from across FirstEnergy helped win this landmark settlement. Now we plan to redouble our efforts to also win the strong, first union contract that Harrison workers deserve.”
The settlement resolves legal charges filed by UWUA against FirstEnergy at the Harrison plant. In January 2013, the NLRB issued a complaint charging that FirstEnergy had illegally slashed Harrison workers’ pay and benefits during 2012 without bargaining. The NLRB recently announced plans to amend the complaint to add new charges filed by UWUA after FE withheld another wage increase plus annual productivity bonuses due to Harrison employees for 2013.
UWUA members from throughout FE played a key role in forcing the company to come to terms in Harrison. Every UWUA local circulated petitions from union members demanding that CEO Tony Alexander restore the wages and benefits unlawfully taken from Harrison employees. The UWUA delivered those petitions – which garnered huge rank-and-file support – to Alexander a few days before the company finally agreed to resolve the Harrison charges.
The settlement requires FE to pay backpay to all Harrison workers victimized by the company’s illegal conduct, to implement the previously-withheld wage increases, and to restore and even improve the incentive bonuses and other employee benefits improperly slashed by the company.
The UWUA extends its thanks to every UWUA member who stepped up to the plate to support our brothers and sisters at Harrison. This victory proves once again that solidarity is a powerful force against corporate greed. We are making plans to escalate our member mobilization to turn back FE’s anti-worker assault against all other UWUA local unions. Stay tuned!

Contract Negotiations
• The Lead Negotiator for the Company has said that she intends to change every section of our contract.
• So far after 4 days of negotiations, FE has proposed the following concessions:
1. Increasing the probationary period for new Power Station employees. These employees can be discharged without cause.
2. Reduce off time rest periods for employees who work 16 hours in a 24 hour period.
3. Reduce holiday rate from 2 ½ times straight time to 2 times straight time.
4. Require mandatory overtime with no consideration given to employees with personal or health reasons who may wish not to work, even when other employees are willing and able to work.
5. Elimination of Ready Response Call Truck and pay to respond directly to customer outages from home. Employees must drive to Service Center without pay, then proceed to customer outage. Pay begins at Service Center .
6. Require mandatory take home pager with no pay.
7. Require 100% mandatory callout acceptance.
8. Elimination of line worker daylight schedule. All employees subject to shift work, 7 days per week schedule at straight time on both Saturday and Sunday.
9. Elimination of entire Customer Satisfaction section of CBA.
10. Reduce change of schedule notice from 7 days to 47.5 hours.
11. Eliminate Weekend Line Workers.
12. Reduce Sunday Premium pay for Operators in Power Stations.
13. Eliminate all meals for employees who work restoring customer service between the hours of 6:30 p.m. to 7:30 a.m.
14. Restrict opportunities to eat meals in restaurants during restoration of services. Company encourages crews to eat at McDonalds and Sheetz to save Company time and money.
15. Reduce meal allowance to $15.00 (amount taxable) and require meals to be completed in forty five minutes.
16. Contract tow boat and unloading operations, bulk material handling and maintenance and pulverizer rebuilds at power station.
17. Reduce cancelation of pre-arranged work notice.
18. Restrict job bidding in Power Stations.
19. Eliminate Company vehicles for meter readers and collectors. Employees will be forced to use their own personal vehicle for normal duties and storm duties.

20. Reduce contribution to FR Clothing Program
21. Safety – Diminish 16 hour guidelines
First Energy classifies all the above proposals as non-economic and thus far has refused to address any proposals they deem economic.
So far these Company proposals revise 24 separate sections of the CBA, delete 7 sections completely and add at least 5 new concessionary sections to the CBA.

The Union office received a call from United States Senator Bob Casey’s office offering to help the Utility Workers Union of America members with any problems that have occurred related to Hurricane Sandy. The Union appreciates the Senator’s concern and encouragement that we all remain safe during the restoration of service process.

After having a baby you MUST enroll the child in your medical plan within 30 days to have continuous coverage for the child. If you exceed the 30 day enrollment period after birth, you will only be able to enroll the child during the System Local 102 open enrollment period in March. There will be no exceptions to the above!

System Local 102 has reached a tentative agreement with Allegheny Energy that will provide a Labor Agreement that will expire April 30, 2013. The new agreement will be voted on by the membership in Maryland, Pennsylvania, West Virginia and Virginia during the month of August. The tentative agreement provides enhanced job security, wage increases and the resolution of other work place issues.

The Membership rejected the Voluntary Holiday Call Truck Program by 76%.
From this point forward, the Weekly Call Truck, when offered, must be filled for the entire week. The Weekend Call Truck, when offered, must be filled on Saturday and Sunday, with Friday being optional for the Member.

Welcome to the new System Local 102 Web Site. Please have patience with us as we are still updating some of the pages of the site. With the pending First Energy buy out of Allegheny we wanted to get the site online. The Union has been told by Allegheny we should not experience any changes from a Service Center level down. They characterized the pending sale of the company would be business as usual for Service Centers. We have been working with other organizations to learn as much as possible about the sale.

The Union won the Tim Chiplaskey arbitration discharge case. The Arbiter ruled the discharge was improper. Tim shall return as a memeberingood standing. The ruling stated that Tim must be made whole in every way with back pay, 401K money, any job bids denied, and all other benefits to make him whole.
This is the second arbitration case in a row that the Union has won. Many thanks go to Bob Chet who put on a great case for us. Bill Sterner and Dave Corb who really fought hard to get this case arbitrated. Spencer Epps, Joe Zimmerlink and Matt Larew really worked hard with thier research and testimony on Tim's behalf.
All participating 102M members gave an honest effort when testifying and preparing for this arbitration. Honesty always pays.
The Union hit a home run in our March 27, 2007 Arbitration. The issue was the company not filling a retirement as a permanent vacancy. Instead they filled it as a temporary vacancy. The company denied 4 Union members 2 months of upgraded pay. This happened at Hatfields Ferry Power Station in the Coal and Ash Unit.
As a result of the company's violations of the contract they have to make whole all affected members that were denied their line of progression move ups. Including a deceased members estate because he passed away prior to this decision. They must pay all back money including adjustments to their 401k accounts. Jim Lewis really put on a great case for the Union. Dave Corob, and Joe Zimmerlink were key players in their testimony which enabled 102 to prevail. This is just the beginning of many more successulcontract battles with Allegheny. Please read the complete document in PDF format HERE.

System Local 102 Update
The Union continues negotiate System Transmission crews and Mobile Maintenance crews with the company. Two points of disagreement are wages and travel. We are hopeful to get an agreement soon so both of these important jobs can start.
The company has presented the Union with a new way to operate the Retail Delivery system. The new system will include a remodeling of the service center and distribution facilities. The Retail Delivery Drivers will have a greater hand in material control and storeroom operation at the Service Center level. There will be a pilot program at Kittanning and Berkley Springs Service Centers to test the new program.
The Union recently met with the Allegheny's Vice President of distribution about restoration of service and service reliability concerns. We discussed storm management, interaction of various work groups, maintenance procedures, and host of various issues related to customer outages. The company is looking at ways to better manage storm events with technology and utilization of the work force. The union provided many good suggestions to help get our customers power restored safely and timely. Please continue to accept call outs help our company reach the benchmarks set forth by the PUC.
